House Judiciary Committee Republicans are suing the Justice Department to make two line attorneys who worked on the Hunter Biden investigation testify.
The GOP had previously issued a subpoena to the two men, along with other DOJ officials. They argued in the Thursday filing that the committee still wants to question the two tax attorneys, who they claim changed their stance after initially suggesting tax charges for Biden.
The committee wrote in its lawsuit that it is investigating whether the DOJ is showing fair treatment to Hunter Biden and if they are committed to impartial justice, given evidence that suggests favorable treatment for him.
The committee needs testimony from Mark Daly and Jack Morgan, two current or former Tax Division attorneys, to gather all facts related to the irregularities in DOJ’s investigation that seem to have benefited Hunter Biden, in order to create legislative reforms and determine whether President Biden has committed an impeachable offense.
The lawsuit for testimony from the two attorneys comes as Hunter Biden is already facing serious tax charges in California, covering the period from 2017 to 2020.
However, Republicans want to discuss with the attorneys information related to Biden’s taxes in 2014 and 2015, the years he served on the board of Ukrainian company Burisma.
Republicans claim that Daly and Morgan are impeding Congress’s ability to conduct oversight and investigate Executive Branch corruption by not appearing for depositions as per the subpoenas.
The Hill has asked the Justice Department for comment.
In response to the subpoena, the Justice Department raised concerns over the scope of the committee’s investigation, citing that it is ongoing.
The Justice Department mentioned in a February letter that the Committee has not provided any evidence indicating improper interference by President Biden in the Department’s work, including as described in the impeachment resolution.
The Justice Department highlighted that they have already taken significant steps to address the committee’s interest by allowing testimony from six senior Department officials, including Special Counsel [David] Weiss.
The lawsuit demonstrates that Republicans are remaining focused on Biden’s taxes, despite the arrest of a former FBI informant for lying to the agency about an allegation that Biden and his father took a bribe. The indictment indicates that the informant fabricated the matter due to his support for former President Trump.
The lawsuit also intensifies a long-standing conflict between House Judiciary conservatives and the Justice Department.
The Republican Party has accused the department of being “weaponized” against conservatives, viewing the Biden investigation as proof of a failure to pursue fair justice.
However, Hunter Biden is currently facing charges in two states, including tax charges in California and gun charges in Delaware.
